In Campbell, California a 59 year old man was riding his bicycle perfectly legally along the shoulder of a road when a 21 year old woman crossed over the shoulder and hit the man, killing him.
She fled the scene, which warranted a news article about the incident, in which a district attorney said:
“There is no problem if you get in an accident and stay at the scene,” assuming alcohol, drugs or other violation aren’t involved, said Ramos, the supervising district attorney overseeing the case. “It becomes a crime if you leave. So you’ve got to stick around.”
So its not a crime if you just kill someone on a bicycle driving a motor vehicle in California. Because of the hit-and-run though:
The San Jose woman faces a maximum sentence of four years in prison if she is convicted in the killing of [the] bicyclist… But she is likely to get far less since she doesn’t appear to have a criminal record.
Except that she just murdered a human being.
This is appalling and sick. Santa Clara County prosecutor Luis M. Ramos and anyone else in the strip-mall injustice system responsible for allowing a murderer to get off so lightly should also be permanently barred from public office and put in jail.
